Trademark Policy
How trademarks are protected on Javern and how to report infringement.

Javern respects trademark rights. This policy explains what constitutes trademark infringement on the Platform and how brand owners can report it.
1. What trademarks cover
A trademark is a sign — usually a name, logo, wordmark, or design — that identifies goods or services from a particular source. Trademark rights can be registered or established through use.
2. What infringes trademarks on Javern
- Listing counterfeit goods that mimic a trademarked brand.
- Using another brand's name or logo in Store branding, product titles, or descriptions in a way that misleads Buyers.
- Registering a Javern username, Store name, or display name that impersonates a well-known brand.
- Selling replicas that closely copy a trademarked product's distinctive design.
3. What isn't infringement
- Descriptive fair use — using a brand name to accurately describe a compatible product (e.g., "cotton socks like Nike" is not, but stating "Nike-brand socks" without them being genuine is).
- Nominative fair use — using a brand name in a review or comparison, where necessary and not misleading.
- Genuine resale — reselling authentic, unaltered branded items you legitimately own, provided it is not against the brand's own resale terms.
4. Report trademark infringement
To report:
- Contact our support team with the subject "Trademark infringement report".
- Include:
- Your name and contact information.
- The trademark(s) you're claiming — with registration numbers or evidence of unregistered rights.
- Link(s) to the infringing listing, Store, or content on Javern.
- A statement, made in good faith, that the use is not authorised by the trademark owner, agent, or the law.
- A statement, under penalty of perjury, that the information you provide is accurate and that you are the rights-holder or authorised to act on their behalf.
5. What happens after a valid report
- We review the report.
- Confirmed infringing listings and content are removed.
- The Vendor is notified.
- Repeat infringers are suspended or permanently removed. Counterfeit sales are grounds for immediate removal.
6. Counter-notice
Vendors who believe their content was removed in error may submit a counter-notice through support, following the same process as the Copyright Policy.
