Intellectual Property Policy

How intellectual property is protected on Javern and how to report infringement.

Javern respects intellectual property (IP) rights and expects everyone on the Platform to do the same. This policy explains how IP is handled on Javern and how to report infringement.

1. Javern's IP

  • The Javern brand, logos, wordmarks, product names, designs, code, and interface are the property of Nixon Cloud Limited.
  • You may not copy, modify, reverse-engineer, or use Javern's IP for any purpose other than using the Services as intended.
  • Press use of the Javern logo requires prior written permission.

2. Your content

  • You retain ownership of the Content you submit — product photos, descriptions, chat messages, reviews.
  • By submitting Content, you grant Javern a worldwide, non-exclusive, royalty-free licence to host, display, and distribute it as needed to operate and promote the Services.
  • You warrant that you have all necessary rights to the Content you submit and that it does not infringe anyone else's IP.

3. What infringes IP on Javern

  • Counterfeit goods — items falsely marketed as a designer or trademarked brand. See the Prohibited Items Policy.
  • Unauthorised use of trademarks — using another brand's name, logo, or slogan without permission. See the Trademark Policy.
  • Copyright infringement — copying photos, product descriptions, artwork, or other creative work without a licence. See the Copyright Policy.
  • Design piracy — cloning another Vendor's original designs, packaging, or presentation.

4. Report IP infringement

If you believe your IP rights are being infringed on Javern:

  1. Contact our support team with the subject "IP infringement report".
  2. Include:
    • Your name and contact information.
    • The IP right you're claiming (trademark, copyright, design).
    • Evidence of your ownership (registration certificates, prior publications, etc.).
    • Links to the infringing listing(s) or content on Javern.
    • A statement, made in good faith, that the use is not authorised by you.
    • A statement, under penalty of perjury, that the information you provide is accurate.

We aim to review IP reports promptly and take appropriate action.

5. What happens after a report

  • We review the report and, where warranted, remove the offending content.
  • The Vendor is notified and given an opportunity to respond.
  • Vendors with confirmed IP violations may be suspended or permanently banned. Repeat infringers are removed.

6. Counter-notice

If you believe a listing was removed in error, you may submit a counter-notice through support with:

  • Identification of the removed content.
  • A statement that you have a good-faith belief the removal was in error.
  • Your contact information.

We will restore the content if the original reporter does not pursue further action within a reasonable time.

7. Repeat infringers

Vendors who repeatedly violate this policy will be permanently removed from Javern, regardless of Store standing.
